Statement from ABOR Chair Larry E. Penley regarding AG petition to Arizona Supreme Court
May 21, 2021
"Arizona courts have repeatedly upheld and recognized the legal purview of the Arizona Board of Regents and its public universities to develop university property, which provides a smart and entrepreneurial mechanism to help fund university operations and provide needed capital assets.
"The board is greatly disappointed in the Attorney General’s decision to prolong senseless litigation in the Omni case by asking the Arizona Supreme Court to review his latest defeat in the Arizona Court of Appeals. This litigation has been rebuked at every turn by Arizona courts. It is regrettable that Arizona taxpayers lose most of all as the Attorney General refuses to recognize and uphold established law and instead insists on a further waste of taxpayer dollars."
